Terms of Service for IndiSanté

Welcome to IndiSanté! These Terms of Service ("Terms") govern your access to and use of IndiSanté's website, mobile applications, and related services (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our Services.

1. Acceptance of Terms

By creating an account, accessing, or using the Services, you affirm that you are at least 18 years old and capable of entering into a legally binding agreement.

2. Description of Services

IndiSanté provides a platform for individuals, primarily Indian students and migrants in Europe, to connect with healthcare providers for telemedicine consultations, language assistance, and culturally sensitive support. Our Services include, but are not limited to, AI-powered triage, doctor search and booking, video consultations, and digital document management (e.g., prescriptions, reports).

Important Note: IndiSanté is a platform that facilitates connections. We are not a healthcare provider, and the medical advice, diagnosis, or treatment provided by healthcare professionals through the Services is solely their responsibility. We do not practice medicine or any other licensed profession.

3. User Accounts

• Account Creation: You may need to register for an account to access certain features of the Services. You agree to provide accurate, complete, and current information during registration and to update it promptly.
• Account Security: You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
• Eligibility: You must meet the eligibility criteria for receiving healthcare services in your location and/or for cross-border telemedicine as per applicable laws.

4. User Responsibilities

• Accurate Information: You are responsible for providing accurate and complete medical history and information to healthcare providers.
• Lawful Use: You agree to use the Services only for lawful purposes and in compliance with all applicable laws and regulations in France, India, and the European Union.
• Prohibited Conduct: You agree not to:
  • Use the Services for any fraudulent or illegal activity.
  • Impersonate any person or entity.
  • Interfere with or disrupt the integrity or performance of the Services.
  • Attempt to gain unauthorized access to any part of the Services or related systems.
  • Upload or transmit any malicious code, viruses, or harmful files.

5. Fees and Payment

• Service Fees: Certain Services may be subject to fees. You agree to pay all applicable fees and charges as described on the Services at the time of booking or use.
• Payment Processing: We use third-party payment processors. Your payment information will be handled in accordance with their privacy policies.
• Refunds: Refund policies for consultations and other services will be outlined separately on our platform.

6. Intellectual Property

All content, features, and functionality of the Services (including but not limited to text, graphics, logos, icons, software, and the compilation thereof), are the exclusive property of IndiSanté and are protected by copyright, trademark, and other intellectual property laws. You may not use any content from the Services without our prior written permission.

7. Disclaimers

• No Medical Emergency: The Services are NOT for medical emergencies. If you have a medical emergency, please call your local emergency services number immediately.
• No Doctor-Patient Relationship (with IndiSanté): Your use of the Services does not create a doctor-patient relationship between you and IndiSanté. The doctor-patient relationship is solely between you and the healthcare provider you consult.
• "As Is" Basis: The Services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. IndiSanté does not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses.

8. Limitation of Liability

To the fullest extent permitted by applicable law, IndiSanté shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Services; (b) any conduct or content of any third party on the Services; (c) any content obtained from the Services; and (d) unauthorized access, use, or alteration of your transmissions or content.

9. Indemnification

You agree to defend, indemnify, and hold harmless IndiSanté, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another.

10. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Paris, France.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
